BOULDER CITY CLARIFIES PROHIBITION OF SHORT TERM RENTALS

On March 26, 2024, the City Council voted 4-1 to approve an ordinance to clarify the prohibition of short term rentals (including Airbnb and VRBO) within the community. The ordinance passed after input from residents through public meetings, a citizens workshop, community survey and deliberation by Council members.  

Short term rental (STR) units are defined as a permanent residential dwelling unit, or any portion of the unit, that is rented for occupancy for a period of less than 30 consecutive calendar days. Prior to the March 26 vote, City Code did not allow for STRs either as a permitted or conditional use. The ordinance specifies that STRs are prohibited and sets fines for those who operate STRs.

In their vote, the City Council said the primary function of residential development is to provide housing for the residents of the City. Commercial, short term rental use of homes, townhomes and condos for temporary lodging conflicts with this function, while negatively impacting the availability of long-term residential housing. Short-term rentals also take customers from traditional hotels and motels, impacting revenue to businesses, local governments and other agencies that benefit from lodging taxes.

Homeowners running an STR in Boulder City face fines of up to $500 per day.
